Limitation Of Liability

Nothing in this Agreement shall limit or exclude Vendor’s liability for: (i) death or personal injury resulting from negligence; (ii) fraud or fraudulent misrepresentation; (iii) breach of any express or implied terms of this Agreement; (iv) its indemnification obligations under this Agreement; or (v) the willful default or willful misconduct of Vendor, its employees, agents, or Sub-Contractors. Voorhees University shall not be liable to any Vendor whether in contract, tort (including negligence) or restitution, or for breach of statutory duty or misrepresentation, or otherwise, for any: (i) loss of profit; (ii) loss of business; or (iii) indirect, special, punitive, or consequential damages suffered by Vendor that arises under or in connection with this Agreement, and Voorhees University’s total liability arising under or in connection with this Agreement are null/void/ and all other matters.

Right To Terminate

Voorhees University has the right to terminate a vendor’s pass, and /or request that an individual or Vendor leave the premises for failing to follow the limitations of liabilities. At this time the Vendor has breached their contract and will not be allowed to participate in any activity on Voorhees University’s premises. All guests must have the following in his/her/their possession at all times:
• A valid pictured ID card
• Vendor’s Pass
• The Vendors contact person signature with a copy of this contract to enter the premises.
